TERMS AND CONDITIONS OF SERVICE

1. ACCEPTANCE OF TERMS
By registering, accessing or using the services of U.better sports consultancy ("U.better"), whether through the ubettersports.com website or any associated platform, the student ("Athlete") declares to have read, understood and fully agreed to these Terms and Conditions and our Privacy Policy, which forms an integral part of this agreement.
2. ELIGIBILITY (AGE RESTRICTION)
2.1. The Athlete declares that he/she is over 18 (eighteen) years of age or at least 16 (sixteen) years of age and has the legal authorization of his/her parents or guardians to adhere to these Terms and use the Services.
3. INDIVIDUAL RESPONSIBILITY AND HEALTH
3.1. The Athlete acknowledges that the practice of sport involves health risks, including, but not limited to, injuries, cardiorespiratory disorders and other incidents.
3.2 The U.better strongly recommends that the Athlete undergoes periodic medical examinations and obtains the express clearance of a health professional before starting any training program.
3.3 Athletes declare that they are in full physical and psychological condition to take part in the activities and assume full responsibility for their own health and safety.
4. EXEMPTION FROM LIABILITY
4.1. U.better, its coaches and collaborators will not be held responsible for any damages, injuries, illnesses or complications that may occur during or as a result of the practice of sporting activities.
4.2. Participation in races or events is the sole responsibility of the Athlete.
5. PLANS, PAYMENTS AND AUTOMATIC RENEWAL
5.1 Plans: U.better offers service plans with different durations (e.g. Monthly, Semi-annual, Annual). The fees and details of each plan are presented at the time of purchase.
5.2 Automatic Renewal and Contract Type:
- The Half-Yearly and Annual plans are fixed-term contracts, automatically renewed at the end of the period.
- The Monthly plan is an open-ended contract with 30-day billing cycles, renewed automatically each month.
5.3 Renewal Notice (Semi-annual and Annual Plans): For long-term plans (Semi-annual and Annual), and as required by law, U.better will send a notice by e-mail (to the registered e-mail address) approximately 30 (thirty) days before the plan's renewal and billing date.
5.4 Cancellation (All Plans): The Athlete can cancel the automatic renewal of any plan (including Monthly) at any time before the next billing date, via their profile area on the website or by contacting support.
- Cancellation prevents future charges. The service will remain active until the end of the period already paid for.
- The Monthly plan does not require 30 days' notice to cancel the next renewal.
5.5 Refund Policy: Unless required by law, payments are final and non-refundable. U.better does not offer refunds for unused or partially used subscription periods.
6. GUIDELINES AND CONDUCT
6.1 The athlete undertakes to follow the instructions of the coaches and to use suitable equipment.
6.2 The U.better reserves the right to suspend or disqualify any Athlete for inappropriate, disrespectful or dangerous behavior.
7. INTELLECTUAL PROPERTY
7.1 All materials provided by U.better, including training plans, videos and articles ("Content"), are the exclusive property of U.better.
7.2 U.better grants the Athlete a limited, personal, non-transferable and non-exclusive license to access and use the Content for his/her personal and non-commercial purposes only. It is strictly forbidden to resell, share, modify or distribute the Content.
8. USE OF IMAGES
8.1. The Athlete authorizes the use of their image in photos, videos and publicity materials for U.better, as detailed in our Privacy Policy. Athletes may request that their image be removed at any time.
9. PRIVACY AND DATA PROTECTION
9.1 U.better takes the privacy of its Athletes seriously. The collection and use of personal data is governed by our Privacy Policy, which complies with Brazil's General Data Protection Law (LGPD), Europe's General Data Protection Regulation (GDPR) and applicable legislation.
10. GENERAL PROVISIONS AND UPDATING OF TERMS
10.1 U.better reserves the right to modify these Terms at any time.
10.2 Any changes will come into effect after their publication on the website. U.better will notify active Athletes of significant changes.
10.3 By continuing to use the U.better services following the publication of an update, the Athlete agrees to and fully accepts the new version of the Terms.
11. APPLICABLE LAW AND JURISDICTION
11.1 These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil.
11.2 The jurisdiction of the District of São Paulo, SP, Brazil, is hereby elected to settle any disputes or controversies arising from these Terms, expressly waiving any other jurisdiction, however privileged.
